Gary Barr and Alexander Kasendorf Successfully Defeat Claim to Real Property on First Demurrer Posted by Admin on Jun 01 2015

 

Representing the Defendant in a lawsuit to establish ownership rights in real property, Gary Barr and Alexander Kasendorf successfully defeated the claim by a demurrer to the original complaint. Gary and Alex were able to successfully argue that, based on the facts stated in the Complaint and recorded with the Los Angeles County Recorder’s Office, the statute of limitations to assert the claim had expired.

 

Demurrers are written objections to pleadings filed by an opposing party which are typically used at the beginning of a case to challenge the legal sufficiency of a case or cause of action. Prevailing on a demurrer to an original complaint without the Court granting leave to amend is highly unusual.
